The law in Washington state if very clear that when a person is arrested for a violation of DUI or Physical Control the police shall make a clear notation in their report if a child under the age of sixteen was present in the vehicle and shall promptly notify child protective services…
It gets worse. When sentencing someone for DUI or Physical Control the judge is required to consider whether a child passenger under the age of sixteen was an occupant in the driver’s vehicle.
